1. About Kollabhouse
Kollabhouse is a software platform that enables creative professionals to manage client projects, proposals, contracts, questionnaires, and related collaboration workflows. Kollabhouse does not provide legal, financial, or professional advice.
2. Eligibility
You must be at least 18 years old to use the Platform. By using Kollabhouse, you confirm you have the legal authority to enter into this agreement.
3. Account Registration
To access certain features, you must create an account. You agree to:
- Provide accurate information
- Keep login credentials secure
- Notify us of unauthorised access
- Accept responsibility for activity under your account
We may suspend or terminate accounts that violate these Terms.
4. Subscriptions & Payments
4.1 Free Project
Kollabhouse offers a free tier that lets you run one full project with one client and limited storage, with no time limit and no credit card required. No payment is collected for the free tier.
4.2 Pro Trial
New accounts may start on a Pro Trial with the same project, client, and storage limits as the free tier until you subscribe to a paid plan. The Pro Trial does not require payment. When you upgrade via Stripe, your subscription begins and full paid-plan features apply from that billing date.
4.3 Billing
Paid plans are billed on a recurring basis (monthly or annually, depending on your selection). Payments are processed securely via Stripe. We do not store full credit card details.
4.4 Renewals
Subscriptions automatically renew unless cancelled before the renewal date.
4.5 Cancellation
You may cancel your subscription at any time through your account dashboard. Cancellation will take effect at the end of your current billing period.
4.6 Refunds
Unless required by law, subscription fees are non-refundable once billed. See our Refund Policy for full details, including billing errors and your rights under the Australian Consumer Law.
4.7 Client Invoicing & Stripe Connect
Kollabhouse allows freelancers to connect their own Stripe account via Stripe Connect to create and send invoices to clients through the Platform.
When you use Stripe Connect:
- You are the merchant of record for client payments — not Kollabhouse
- Client payment data is processed directly by Stripe under Stripe's terms and privacy policy
- You are responsible for compliance with tax, invoicing, and consumer laws applicable to your business and clients
- Disputes, refunds, and chargebacks for client invoices are handled between you, your client, and Stripe
- Kollabhouse provides the software interface only and is not a party to the payment contract between you and your client
Kollabhouse subscription billing (your plan fees) is separate and processed by Kollabhouse via Stripe as described in sections 4.3–4.6 above.
5. User Content
You retain ownership of all content you upload to the Platform ("User Content"). By uploading content, you grant Kollabhouse a limited licence to store, process, display, and transmit your content solely for the purpose of operating the Platform.
You are responsible for ensuring that your content:
- Does not infringe copyright
- Does not violate privacy laws
- Is not unlawful or defamatory
- Does not contain malicious code
We reserve the right to remove content that violates these Terms.
6. Acceptable Use
You agree not to:
- Upload illegal content
- Attempt to gain unauthorised access to the Platform
- Interfere with security features
- Reverse engineer or copy the Platform
- Use the Platform to distribute malware
- Use the Platform for fraudulent activity
Violation may result in immediate suspension.
7. Intellectual Property
All Platform software, branding, design, and functionality are owned by Kollabhouse. These Terms do not grant you any ownership rights in the Platform. You may not copy, modify, or redistribute any part of the Platform without written permission.
8. Data & Privacy
Your use of the Platform is also governed by our Privacy Policy. If you process client personal data through Kollabhouse, our Data Processing Addendum (DPA) applies. We use third-party infrastructure providers including Cloudflare, Supabase, and Vercel. We implement reasonable security measures but cannot guarantee absolute security.
9. Service Availability
We aim to provide reliable service but do not guarantee uninterrupted access, error-free operation, or permanent availability. We may modify features, update functionality, perform maintenance, or temporarily suspend access without prior notice.
10. Limitation of Liability
To the maximum extent permitted by law, Kollabhouse is not liable for indirect or consequential loss, loss of profits, loss of business, loss of data, or business interruption. Total liability is limited to the amount you paid us in the 12 months preceding the claim.
Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law (ACL) or other applicable consumer protection laws that cannot be excluded by agreement.
11. Indemnity
You agree to indemnify and hold Kollabhouse harmless from claims arising from your use of the Platform, your uploaded content, or your breach of these Terms.
12. Termination
We may suspend or terminate your access if you breach these Terms, misuse the Platform, or when required by law. Upon termination, your access to the Platform will cease.
13. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
14. Changes to These Terms
We may update these Terms from time to time. If changes are significant, we will notify users via email or dashboard notification. Continued use of the Platform after changes means you accept the updated Terms.
